In Greene County district court Kaden Mikel Lowe, 19, of Grand Junction was granted a deferred judgment March 22 after he pleaded guilty to a charge of criminal mischief- third degree, amended from trespass causing damage more than $200 and conspiracy to commit non-forcible felony. He must pay a $625 civil penalty and a $125 Law Enforcement Initiative surcharge. He and co-defendants are jointly and severally liable for $4,755.08 victim restitution. Kooper Robert Behrens, 20, of Carroll was sentenced to two years in prison after he pleaded guilty to a charge of trespass- third degree, amended from criminal mischief- second degree and trespass causing more than $200 damage. The prison term was suspended and he was placed on probation for two years. Behrens was fined $625 with a $218.75 surcharge; both were suspended. Travis Christopher Fincel, 44, of Grand Junction was sentenced to five years in prison after he changed his plea to guilty to a charge of possession of methamphetamine- third or subsequent offense. The prison term was suspended and he was placed on probation for three years. Fincel was fined $750 with a $262.50 surcharge; both were suspended. He must pay a $125 LEI surcharge, a $10 surcharge for drug abuse resistance education (DARE), and $600 restitution for his court appointed attorney’s fees. Court costs in that case were $140.
In a separate case, a charge against Fincel of theft- fourth degree was dismissed. He was assessed $143.72 court costs in that case.
Fincel was sentenced to 12 days in jail on a charge of possession of drug paraphernalia in a magistrate court case. A judgment was entered for a $65 fine with a $22.75 surcharge, a $125 LEI surcharge and a $10 DARE surcharge. (Sentencing: McCarville)
Joby Lee Hoskinson, 35, of Grand Junction was sentenced to 30 days in jail after he changed his plea to guilty to a charge of domestic abuse assault causing injury or mental illness. All but two days of the jail time was suspended. He must pay sheriff’s room and board fees for the time he serves and he must complete the Iowa domestic abuse program at his own expense. He was placed on informal probation for one year. Hoskinson was fined $315 with a $110.25 surcharge; both were suspended. He must pay a $100 domestic abuse surcharge, $600 restitution for his court appointed attorney’s fees, and $207.50 court costs. (Sentencing: McCarville)
Brad Lee Byerly, 50, of Jefferson was sentenced to two years in prison after he changed his plea to guilty to a charge of operating while intoxicated- second offense. All but seven days of the prison term was suspended. He must pay sheriff’s room and board fees for the time he serves. He must complete the recommendations of a substance abuse he has already done and he must complete a community college drinking drivers school. Candice Marie Ortiz, 32, of Grand Junction was sentenced to seven days in jail after she changed her plea to guilty to a charge of possession of methamphetamine. The jail time was suspended and she was placed on probation for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Ortiz was fined $315 with a $110.25 surcharge, a $125 LEI surcharge and a $10 DARE surcharge. She must also pay $500 restitution for her court appointed attorney’s fees and $131.50 court costs. Wetzel was fined $65 with a $2275 surcharge, a $125 LEI surcharge and a $10 DARE surcharge. Court costs were $60.
Keenan Lee Olson, 19, of Coon Rapids was sentenced to six months in jail after he changed his plea to guilty to a charge of carrying weapons. The jail time was suspended and he was placed on probation for one year. He was fined $625 with a $218.75 surcharge.
